Will all Hounslow Streetspace Schemes now be removed? Surely they must.
With the decision of Mrs Justice Lang it must be that all the Hounslow Streetspace schemes must now go. It is quite a damming ruling, stating that the Claim succeeded on 4 out of 5 grounds. Yes there can be an appeal, and yes there might be some taxi bits to it, but Justice Lang has a track record and a good sense on whether appeals are likely to succeed or not, and also there are plenty of non taxi precedents on rationality and Public sector equality duty. She even went on to criticise TfL for behaviour and approach, which is unusual.Seems to me that it was a common sense ruling, to say otherwise would be to say cycleways and Covid traffic measures trump the Equality Act 2010 or Wednesbury on the issue of rationality. And that would be irrational.Will Hounslow Council now sue TfL for illegal guidance. How much will it cost to repay all of those PCNs issued illegally. Getting on and removing the schemes would be a good start.
