A man who dumped waste from his car onto a pavement in Ealing borough has been ordered to pay more than £600 after being caught on CCTV and taken to court by the council.

The case was heard at Ealing Magistrates’ Court on 6 March, where Awil Dahir pleaded guilty to fly-tipping offences under section 33 of the Environmental Protection Act 1990.

Dahir was identified after Ealing Council reviewed CCTV footage showing him stopping his vehicle and dumping boxes onto the pavement. The council has been increasing its use of CCTV to tackle fly-tipping across the borough.

Dahir later claimed he had left the waste because he was worried his car might be struck by a bus. However, the footage showed him returning to his vehicle and remaining there for around ten minutes after the waste had been dumped.

Although Dahir does not live in Ealing, council officers traced him to an address in south-west London. A fixed penalty notice (FPN) was issued, but after it went unpaid the council proceeded with prosecution.

Before issuing an FPN, the council writes to alleged fly-tippers asking them to explain why their waste may have been found dumped. Where there is no response, or where evidence indicates fly-tipping has taken place, the FPN is then sent.

Dahir attended court in person and pleaded guilty at the first opportunity, for which magistrates gave credit during sentencing. After considering his mitigation, the court ordered him to pay a total of £616.

Joe Blanchard, the council’s assistant director for environment and community protection, said, “Fly-tipping is a selfish and illegal act that damages our towns and places an unfair burden on residents and council services. This case shows how seriously we take environmental crime and how CCTV is helping us identify and prosecute offenders, even when they do not live in the borough. We will continue to take firm action to protect the borough’s streets and open spaces.”
