In the normal course of events, yes. But in this case the builders need to build beyond the party wall ie on next door's property ie beyond the party wall. I imagine this ceases to be a party wall matter. Even the builders are declining to build beyond the party wall so a new team of builders are having to be found and I sense a solicitor or two needs to be brought in. There is no dispute; it's just that it seems wise to set out the heretowherefores etc beforehand.
