PCN QUESTION

Maybe Richard will have some answer to this My son has just recieved a PCN for £65 from car rental CO. The Question is this not knowing if they recieved it and paid first being 28 days. The PCN is from August and he has just been notified by the rental firm. How does in this case the 28 days work out. Most likely leaving out a few questions but its a strange one rather thn getting the PCN direct within 28 days

Just to add that this is what we have read. "The ticket will eventually work its way back to the rental car company, which will simply charge you for the ticket and administrative fee down the road. Unpaid fines and rental car administration fee balances will eventually land at a collections agency. ... It's best to pay your fine and move on" Obviously this is the outcome but is it correct is what we are asking before paying

While we’re on the topic, I heard today about someone who had received some PCNs, but wasn’t anywhere near where they were issued. Someone must have cloned his plates. What to do in this situation?

State that you weren’t ever there in your appeal, and request the photos ... it may be obvious that it’s another vehicle with cloned plates, but if it’s the same colour/model look for differences in the photos from your vehicle e.g. dealer stickers. I’d also report it to the police if the vehicle in the photo is very similar to yours - otherwise you might get more pCNs arriving.A friend received pCNs for his Y reg Volvo, and in the photos the vehicle looked identical- it was only the presence of a tow bar (the vehicle was caught for stopping in a yellow box junction towing another vehicle l!) that my friend’s vehicle didn’t have that was obviously different.

My granddaughter hire a car from Stix car in Hammersmith for two weeks, and returned the car back to them.About four weeks later she received a letter from Stix Car Hire asking for payment of a PCN that they paid for the  fine she revived in Shepherds Bush.They included the PCN and wanted there money back for it.So it seem the Stix pay the PCN and then chase the customer for it.

Yeah, he said he’d ask for the photos. Good point on small points of difference if they’ve cloned the same model etc. Has to be an Old Bill notification too I’d have thought - unless faulty ANPR? But not one, but a few PCNs from different areas.

"unless faulty ANPR?"That can happen.  I had a London congestion charge on a day that my car had been parked in Chiswick all day, and asked to see the evidence. It was a straight mis-read, with one digit wrongly read. The photo clearly showed this.  I've also had another 3 or 4 false CC charges which they cancelled, but I haven't seen the photos for those.No misread for Julian's son though.  I've replied to Julian.

For many PCNs e.g. parking, it’s the registered keeper of the vehicle who is liable not the person who was driving/parking.So the car hire firm will pay the PCN and then get it back from the person they hired the car to, because the hirer signed a contract to say they would met the cost of any PCNs incurred. There’s no direct liability to the authority for a parking PCN, so the 28 day period is of no relevance to the hirer.

Thanks Richard He has now paid but just needed some clarification in parts as the time of PCN issued and email from hire Co for the charge was 51 days which is a lot taking everything onboard and being November rather than mid december where one may understand delay in council and hire Co and Royal Mail and alike. Ive sent you a reply thanking you for your help on this matter. TICK
